Terms of service

This document is under legal review.It describes how the platform works today and is written in good faith, but it has not been reviewed by counsel and is not a complete contract. Please contact us before relying on it.
What this service is
The Giving Center is software that charitable organisations use to run matching campaigns: timed fundraising drives in which lead donors (“matchers”) commit capped pools that multiply gifts from the wider community.
We are not the charity, and we do not hold your money
When you give through this platform, you are giving to the organisation running the campaign, not to us. Each organisation connects its own payment processor and its own bank account. Funds settle directly to them. The platform takes no percentage of donations and never holds donated funds.
It follows that the organisation — not The Giving Center — is responsible for how donations are used, for the tax receipt you receive, and for its own charitable status.
If you are an organisation using this platform
- You are responsible for the accuracy of what you publish: campaign goals, match arrangements, and your own charitable and tax status.
- You must have the agreement of your matchers before publishing a pool in their name.
- You are responsible for your own tax receipting obligations. The platform numbers receipts sequentially and without gaps to support that, but the legal duty is yours.
- You are responsible for the personal data of your donors and for how you contact them, including consent and unsubscribe handling.
- You must keep your own account secure, including for anyone you invite.
If you are a donor
- A displayed multiplier reflects match capacity available at the moment it is shown. Pools are capped and can fill; the amount matched is whatever capacity remained when your gift was recorded.
- Refunds are handled by the organisation you gave to. When a gift is refunded, any match it unlocked is released back to the pool.
- You are responsible for the accuracy of details you provide for a receipt.
Acceptable use
Do not use this platform to:
- solicit funds for an organisation you are not authorised to represent;
- misrepresent how donations will be used, or a match that does not exist;
- process payments unrelated to charitable giving;
- attempt to access another organisation’s data, or to circumvent the permission boundaries in this system.
Availability
We work to keep the service available, particularly during live campaigns when a short outage is expensive. We do not currently offer a contractual uptime guarantee, and we would rather say so than imply one.
Suspension
We may suspend an organisation that breaches these terms or that we reasonably believe is misrepresenting a charitable purpose. Where we do, the organisation can export its data.
Liability, indemnity and governing law
[REVIEW] Limitation of liability, indemnity, warranty disclaimers, governing law and dispute resolution are deliberately not stated here. They are the clauses that matter most in a dispute and the ones most often gotten wrong when copied from a template. They need drafting by counsel familiar with both US and Israeli charitable-sector practice.
Changes
We will update this page when the service changes and will move the “last updated” date above. Material changes affecting organisations will be communicated directly.
